In a significant development for India’s legal profession, the Bar Council of India (BCI) has announced that it will convene a meeting next week to implement important directions issued by the Supreme Court of India regarding disciplinary proceedings against advocates. The move is aimed at improving transparency, efficiency, and accountability within the legal profession.

The Supreme Court recently observed that while a bank or any institution may remove an advocate from its panel in cases of professional negligence, it cannot publicly declare such action as professional misconduct. The Court clarified that the authority to determine and punish professional misconduct rests exclusively with the Bar Council under the Advocates Act, 1961.

To strengthen the disciplinary mechanism, the Supreme Court directed the BCI to conduct a comprehensive performance audit of disciplinary proceedings handled by both the Bar Council of India and the State Bar Councils. The audit will examine pending complaints, disposal rates, staffing, procedural timelines, institutional support, and overall efficiency. Based on the findings, appropriate reforms and corrective measures are expected to be introduced to ensure faster, fairer, and more transparent disciplinary proceedings.

Another major recommendation made by the Supreme Court is the establishment of a National Legal Academy, modeled on the National Judicial Academy. The proposed institution aims to promote continuing legal education, professional development, mentoring, ethics training, and specialized skill enhancement for advocates across the country. The initiative is expected to modernize legal education and strengthen professional standards within the legal fraternity.

In response, the Bar Council of India has stated that expert committees will be constituted to prepare a roadmap for implementing the Court’s directions. These committees will focus on institutional reforms, technology adoption, legal education, governance improvements, and modernization of the regulatory framework. The BCI has also confirmed that it will file a compliance affidavit before the Supreme Court within the prescribed timeline, detailing the steps taken to implement the judgment.
